These Terms of Service ("Terms") govern your access to and use of cargo-ai.org and any related hosted services made available under the Cargo AI brand (collectively, the "Service"). The Service is operated by Analyzer 1, LLC ("Analyzer 1," "we," "us," or "our").
By accessing or using the Service, including registering for an account or using a confirmation code to confirm and activate an account, you agree to these Terms and our Privacy Policy.
1. The Service
Cargo AI includes open-source software and hosted account services. These Terms apply to the website and hosted services. Open-source software distributed by us may also be subject to separate license terms, which will govern that software to the extent applicable.
2. Eligibility and Accounts
You must provide accurate information when creating an account and keep it reasonably current. You are responsible for your account, the email inbox used for registration, any confirmation code sent to that inbox, your local devices, your local configuration and tokens, and activity that occurs under your account.
3. Your Content
You retain ownership of the content you submit to the Service, including agent definitions, prompts, inputs, outputs, metadata, and related materials ("Content"). You grant Analyzer 1 a limited, non-exclusive, worldwide license to host, store, process, transmit, display, reproduce, and use your Content as reasonably necessary to operate, secure, maintain, support, and improve the Service and to comply with law.
4. Public and Private Content
Some Service features may allow you to keep content private or make content public. If you choose to make content public, others may be able to view, copy, fork, hatch, use, adapt, or redistribute it. Do not make content public unless you are comfortable with that result. If you designate content as private, we may still access it as reasonably necessary to operate the Service, provide support, protect security, investigate abuse, or comply with law.
5. Your Responsibilities
You represent that you have the rights and permissions needed for your Content and your use of the Service. You are responsible for the legality, accuracy, and appropriateness of your Content and for maintaining your own backups where needed. You are also responsible for reviewing generated outputs, commands, executables, emails, and other materials before using, running, distributing, or relying on them.
6. Acceptable Use
You may not use the Service for unlawful, infringing, harmful, abusive, fraudulent, deceptive, spam, malware, phishing, security-violating, or otherwise unauthorized activity. You may not attempt to interfere with the Service, bypass usage limits or safeguards, or use the Service to violate the rights of others.
7. AI Outputs and Local Execution
The Service may involve AI-generated outputs that can be inaccurate, incomplete, or unsuitable for your intended use. You are responsible for using human judgment and review before relying on any outputs. You are also responsible for any local code, agents, commands, executables, or emails that you generate, hatch, run, distribute, or publish using Cargo AI.
8. Third-Party Services
The Service may rely on third-party software, infrastructure, or model providers. Those third-party services may be subject to their own terms, policies, and availability constraints. Analyzer 1 is not responsible for third-party services or third-party outputs.
9. Suspension and Termination
We may suspend or terminate access to the Service, or remove content, if we reasonably believe doing so is necessary to prevent abuse, address a security risk, comply with law, protect the Service or other users, or enforce these Terms.
10. Changes to the Service
We may change, suspend, or discontinue all or part of the Service at any time, with or without notice.
11. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and update the "Last Updated" and "Effective Date" above. If we make material changes, we may also provide notice by email or through the Service where practical. By continuing to use the Service after the effective date of updated Terms, you agree to the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
12. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Analyzer 1 disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.
13. Limitation of Liability
To the maximum extent permitted by law, Analyzer 1 and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business interruption, arising out of or related to the Service or these Terms. To the maximum extent permitted by law, Analyzer 1's total liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid, if any, to use the Service in the twelve months before the event giving rise to the claim.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Kent County, Delaware, except where applicable law requires otherwise.
